Terms and Conditions

In using this website you are deemed to have read and agreed to the following terms and conditions:

These terms and conditions (“Agreement”) apply to all sales of goods and services (“Product”) by 3D HUB (“Seller”) to the customer (“Buyer”). By placing an order with the Seller, the Buyer acknowledges and agrees to be bound by this Agreement. Any variations to this Agreement must be in writing and signed by an authorized representative of the Seller.

Price

All prices (unless stated otherwise) exclude delivery and shipment fees. The purchase price only covers goods and packing, excluding installations and maintenance.

Prices may be revised at any time without notice.

The purchase price is in New Zealand dollars and excludes GST within New Zealand. Other relevant taxes, duties, insurance, delivery, and handling expenses will be reviewed through the final invoice. 3D HUB is not currently GST registered.

A quotation is not a contract until we have subsequently accepted an order.

Payment Terms

Orders must be paid in full before delivery can take place. If you are using a part pay option like Layby, Afterpay, etc., you need to pay the service provider as per your agreed installments on time.

Delivery

All freight costs are excluded from the purchase unless stated otherwise. If we have agreed to transport the goods to an area, we will make all arrangements.

If no delivery location is mentioned, delivery will take place once the required information is available.

We will make our best effort to ship goods according to the listed timeline, but there is no certainty about the time of delivery as it depends on the service provider. No specific delivery time is guaranteed, and we request that there will be no objections from your side in case of delayed delivery.

Please note that shipment is a service once booked or used, and it cannot be changed or refunded.

Returns, Refunds, and Cancelled Orders

All goods to be returned must have a Goods Return Authority issued by us. The issue of a Goods Return Authority does not guarantee that we will accept the return.

Change of Mind/Buying the wrong product

In case of a change of mind or purchasing the incorrect item, there will be no refund or exchange.

If we agree to return a product, the shipping cost will be borne by the buyer.

Used products will not be returned until there is proof of a manufacturing issue, and the manufacturer agrees to take a return. Some products that require sealing, such as Filaments and Resins, will not be returned if opened.

If an inaccurate product has been provided to you, we will make arrangements for you to receive the right goods you purchased or issue a credit or refund. The incorrect product must be unopened, and the return should take place within a week of shipment or as mutually agreed.

Goods damaged during transportation

In this case, you need to notify us within 48 hours so we can open a claim with the courier service provider. You need to provide us with evidence/photographs to lodge this claim.

Faulty Products

In case the product you received is defective upon arrival or first use, 3D Hub will take responsibility to either repair or replace the product, or issue a credit/refund if a suitable replacement is unavailable. However, to proceed with repair, replacement, or credit/refund, the faulty product must be returned to us for testing and confirmation.

All our products are DIY, and we expect our customers to have reasonable technical skills to assemble products and install parts.

Faulty products during the warranty period

If your product is faulty or has stopped working as intended and is still within the warranty period specified when you purchased your product, 3D HUB will repair or replace your product or issue a credit / refund where a suitable replacement is not available. In order to repair, replace or issue a credit / refund for your faulty product, it will need to be returned to us so we can test and confirm that it is faulty. You may also be able to contact the manufacturer directly to arrange a repair / replacement. Returns of this nature can be made any time within the warranty period and it is your responsibility to cover any costs of returning the product to us.

Test Costs and Shipment Charges

In case of a product return that is not faulty, the buyer will be responsible for all testing fees, freight, and insurance charges that may apply.

Ownership

Once the goods are delivered, ownership of the products is transferred to the customer. Our printers and supplies are intended for use in hobbies, art, education, trade, or industry. Any misuse or illegal use of our products is not the responsibility of 3D HUB.

Guarantees

As per the Consumer Guarantee Act 1993, if the products are for personal use, our refund, return, and cancellation policies apply. However, if the products are purchased for commercial or marketing purposes, the Act does not apply. We do not provide any express warranties or reconstruction efforts or additional features. Our terms and conditions comply with the Act, but we are not responsible for any claim not covered under the Consumer Guarantee Act, Sale of Goods Act, or any other local legislation. We do not offer any guarantees or warranties for negligence and mishandling.

Warranty Period

We provide a warranty only for the period mentioned by the manufacturer. We do not offer any independent warranty. The general warranty period is 12 months from the purchase date. The warranty period for mechanical parts, such as Extruder, Hotend, and cooling fans, is 3 months. Consumable items, including hotbed platform, nozzles, FEP film, and VAT kit, have no warranty once used. Materials like filaments and resins also have no warranty. Laser modules have a warranty of either one year or their rated lifecycle, whichever comes first.

Overdue Payment

If the payment is not made by the due date, a default penalty of 2.5% per month, including any GST, is charged until the payment is made. Customers are responsible for all costs related to late or overdue payments, including lawyer and court costs and disbursements.

Event of Default

For individuals, default is defined as being unable to follow any terms and conditions or being involved in bankruptcy or creditor arrangements. For companies, default is performing an act that could result in liquidation, a decision to liquidate, or the appointment of a statutory manager. In such cases, we can suspend or terminate the contract, and all payments become due immediately.

Right to Contact/User Information

We have the right to obtain and provide any information about the customer to and from any person or debt collection agency for business purposes. Customers must inform us of any changes in their contact information.

Limitation of Liabilities

We are not responsible for any delays or losses that occur during the fulfillment of the contract. We are only responsible for payment of the products and services we offer. We are released from our obligations in cases of circumstances beyond our control, such as strikes, riots, natural disasters, or operation of law. We are not responsible for any misuse or illegal use of our products.

Indemnity

The indemnity value for any damage or loss caused by faulty equipment will not exceed 10% of the equipment’s purchase value.

Waiver

Any waiver of the agreement or contract must be provided in writing and approved by an authorised personnel. If we fail to provide any service, we will try to ensure it does not harm our customers or business in any way in the future.

Assignment

Customers cannot direct or transfer any of their rights without written permission.

Governing Law

All the terms and conditions of this contract comply with New Zealand laws. Both the customers and 3D HUB submit to the jurisdiction of the country’s courts.
